Companies must have sufficient technical, financial, and human resources for SMS implementation. Top management must submit a self-declaration form.
- Technical Management: Organizations managing ships must have sufficient authority and capabilities for SMS implementation.
- Change of Management: Owners must notify the Directorate at least 7 working days before changing management. The new manager must have a valid DOC and ensure the vessel is in compliance with statutory requirements.
- Change of Flag/Ownership/Registry: Owners must promptly notify the Directorate and surrender the original SMC if the vessel changes flag, ownership, or closes its registry.
2. Safety Management System (SMS)
Companies must develop, implement, and maintain an SMS that includes functional requirements of the ISM Code.
- SMS Manuals: Companies must develop their own SMS manuals, including an apex manual (Safety Management Manual) and other relevant manuals, instructions, checklists, and forms.
- Designated Person Ashore (DPA): Companies must appoint a DPA with the required qualifications and experience. The DPA's role and responsibilities are guided by IMO Circular MSC-MEPC.7/Circ.6.
3. Document of Compliance (DoC)
A DoC is issued to a company when its shore-side aspects of the SMS comply with the ISM Code requirements. The DoC is specific to the ship type(s) operated by the company.
- Application Process: Companies must submit an application letter, background information, organization structure, and the required fee to obtain an Indian DoC.
Companies must ensure that all personnel, including DPAs, have the required qualifications and experience. Failure to comply may result in the DOC becoming null and void.
