Consolidation of Requirements for Implementation of MARPOL Annex V
Key Changes and Requirements
1. General Prohibition on Discharge of Garbage
Garbage discharge into the sea is prohibited, except under limited circumstances. All plastics, including incinerator ashes, are prohibited from discharge at any time.
- Exceptions: Discharge may be permitted under specific conditions, such as while enroute, as far as practicable from land, and not less than certain distances.
2. Special Requirements for Fixed or Floating Platforms
Discharge of any garbage from fixed or floating platforms and from all other ships when alongside or within 500m of such platforms is prohibited, except for food wastes under specific conditions.
3. Discharge of Garbage within Special Areas
Discharge of food wastes and cargo residues is permitted within special areas under specific conditions, such as while enroute, as far as practicable from land, and not less than certain distances.
4. Exceptions and Reception Facilities
Exceptions to discharge prohibitions include securing the safety of a ship and its crew, accidental loss, and protection of the marine environment. All ships visiting Indian ports must raise Advance Notification on Swachh Sagar Portal.
- Placards: Display placards notifying crew and passengers of discharge requirements.
- Garbage Management Plan: Carry a plan based on MEPC.220(63) for minimising, collecting, storing, processing, and disposing of garbage.
- Garbage Record Book: Maintain and retain a record book for all ships of 400 gross tonnage and above, and for ships carrying 15 or more persons. Record each discharge, incineration, or disposal.
Compliance with MARPOL Annex V is mandatory for all ships operating in Indian waters. Non-compliance may result in penalties and legal consequences.
