Key Changes and Requirements: Seafarer Fundamental Rights

1. Seafarer Fundamental Rights

Seafarers have the following fundamental rights as per the Maritime Labour Convention 2006 (MLC):

  • Collective Bargaining: Right to join trade union of choice and bargain collectively.
  • Forced Labour: Right not to be treated as a slave and to be paid for work.
  • Discrimination: Right to be free from discrimination in employment and occupation.
  • Work Hours: Right to regulated work hours.

2. Seafarer Employment Agreement (SEA) / Collective Bargaining Agreement (CBA)

Key points to consider in your SEA/CBA:

  • Duration: Clearly stated contract duration, no unilateral changes by shipowner.
  • Wages: Basic wages, overtime pay, and leave entitlement clearly stated.
  • Repatriation: Shipowner responsible for repatriation costs.
  • Wage Payment: Full payment of wages earned at the end of each calendar month.
  • Union Rights: No clause restricting your right to join, contact, or be represented by a trade union.
II/4  Ensure you are given and retain a copy of the contract you have signed.

3. Making a Claim for Death or Long-term Disability

Seafarers or their Next of Kin (NoK) can claim compensation for death or long-term disability as per agreed terms and conditions in the CBA.

If there are delays, approach the Directorate General of Shipping (DG Shipping) for assistance.

Important Note

If abandoned, seek immediate help from Port State Control, Flag State, Indian Embassy, DG Shipping, ITF, trade unions, or welfare organizations.
